The following terms (hereinafter referred to as this "Agreement") constitute a legally binding agreement between you and Huawei regarding the HUAWEI Analytics Service. It is supplementary to the HUAWEI Analytics Service Agreement. This Agreement stipulates the legal rights and obligations of you and Huawei after you enable the Data Sharing function of HUAWEI Analytics. By checking the box in the AppGallery Connect agreement pop-up window to agree to all the agreements applicable to AppGallery Connect services (including this Agreement), or by checking the box next to "I have read and agreed to HUAWEI Analytics Data Protection Agreement" below this Agreement, or by enabling the Huawei product improvement function of HUAWEI Analytics under this Agreement, it shall be deemed that you have fully understood and accepted the terms of this Agreement and the HUAWEI Analytics Service Agreement as of the date of your such acceptance and use ("Effective Date"). Any and all matters unaccomplished herein shall be subject to the HUAWEI Analytics Service Agreement. If you do not agree to this Agreement, you shall stop using the services under this Agreement.

1. Definitions

Unless otherwise specified in this Agreement, terms in this Agreement have the same meaning as those in the HUAWEI Analytics Service Agreement. Unless otherwise specified, the following term shall have the following meaning:

1.1 "Huawei product improvement" means the product improvement function provided by HUAWEI Analytics. If you decided to enable this function, it shall be deemed that you have agreed to share your HUAWEI Analytics data with Huawei in order to enhance functions such as user analysis and uninstall analysis and help Huawei improve its products and services.

2. Applicable Scope

2.1 This Agreement is only applicable to your personal information processing behavior as a personal information processor (herein and hereinafter as defined in the Personal Information Protection Law of the People's Republic of China, which corresponds to the data controller defined in the EU's General Data Protection Regulation) after the Huawei product improvement function of HUAWEI Analytics is enabled.

3. Roles and Restrictions on Data Processing

3.1 When Huawei provides you with this Service, you and Huawei are independent personal information processors.

3.2 You and Huawei shall independently determine the purposes and methods of personal information processing.

3.3 You shall fulfill your obligations concerning the processing of personal information in accordance with any and all applicable laws and regulations of data protection.

Clauses 3.1 to 3.3 do not affect any restrictions on the right of you or Huawei to use or otherwise process personal information. For the avoidance of doubt, this Agreement does not supersede or affect the relevant provisions of the HUAWEI Analytics Service Agreement in which Huawei is an entrusted personal information processor.

4. Privacy

4.1 You must obtain legally valid consent from End Users before sharing their personal information for Huawei product improvement. When obtaining such consent, you must keep the records of consent given by End Users and provide clear instructions for End Users about how they can withdraw their consent.

4.2 Either Party may transfer the Personal Data of the controller to a third country/region provided that it complies with the applicable data protection laws and regulations regarding the transfer of personal data to a third country/region.

5. Termination of This Agreement

5.1 If either Party terminates the HUAWEI Analytics Service Agreement, this Agreement shall automatically terminate on the same day.

5.2 You may terminate this Agreement by going to the AppGallery Connect website, clicking the My projects icon, selecting a project, and disabling Huawei product improvement under HUAWEI Analytics > Management > Analysis settings.

5.3 If Huawei decides to discontinue this Service or make major changes to it, Huawei reserves the right to terminate this Agreement after informing you in advance.

5.4 The termination of this Agreement does not entail the automatic termination of the HUAWEI Analytics Service Agreement signed by and between you and Huawei.

5.5 If this Agreement is terminated, Huawei has the right to delete all the permissions and resources of HUAWEI Analytics stored on your Developer Account.

6. Distribution Area and Signing Huawei Entity

You acknowledge and agree that the provisions regarding the distribution area and the signing Huawei entity under this Agreement shall be subject to the "Distribution Area and Signing Huawei Entity" clause in the HUAWEI Analytics Service Agreement.

7. Governing Law and Dispute Resolution

You acknowledge and agree that the provisions regarding the governing law and dispute resolution under this Agreement shall be subject to the "Governing Law and Dispute Resolution" clause in the HUAWEI Analytics Service Agreement.
